1. ACCEPTANCE OF TERMS

By scheduling an appointment, receiving therapy services, or accessing any services provided by AdvanceWave LLC ("AdvanceWave," "we," "us," or "our"), you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

2. IMPORTANT DISCLAIMERS

2.1 Not a Medical Practice

CRITICAL NOTICE: AdvanceWave LLC is NOT a medical office, medical practice, or healthcare provider. We do not:

  • Evaluate medical conditions

  • Make medical recommendations

Any perception or reliance on our services as medical advice or medical recommendations constitutes practicing medicine without a license in the State of Texas, which is a felony offense.

2.2 Nature of Services

AdvanceWave provides conservative, non-invasive therapy services using Extracorporeal Shockwave Therapy (ESWT) technology. Our services are therapeutic in nature and are not medical treatments.

We consistently use the term "therapy" rather than "treatment" to accurately reflect the non-medical nature of our services.

2.3 Professional Medical Consultation Required

  • To rule out any underlying medical conditions

3. SERVICE DESCRIPTION

3.1 Extracorporeal Shockwave Therapy (ESWT)

AdvanceWave provides non-invasive therapy using the SoftWave TRT device, which delivers high-energy sound waves (shockwaves) through the skin to promote natural healing processes.

3.2 FDA Clearance

The SoftWave TRT device is an FDA Class 1 medical device with 510(k) clearance for:

  • Activation of connective tissue

  • Pain reduction

  • Improved blood supply

  • Treatment of chronic diabetic foot ulcers

  • Treatment of acute second-degree burns

4. CLIENT RESPONSIBILITIES

4.1 Medical Clearance Requirement

For certain conditions, particularly cognitive-related concerns, you may be required to obtain approval from your licensed physician before receiving ESWT therapy.

This requirement exists to rule out any malignant disease, undiagnosed tumors, aneurysms, or other serious underlying conditions that could create additional risks or complications.

If you choose not to provide medical clearance when requested:

  • You acknowledge increased risk of undiagnosed conditions

  • You accept full responsibility for any complications

  • You release AdvanceWave from liability related to these risks

4.2 Accurate Information

You agree to:

  • Provide complete and accurate health history information

  • Disclose all relevant symptoms and conditions

  • Update us on any changes to your health status

  • Inform us of any adverse reactions or concerns

4.3 Informed Consent

By receiving services, you acknowledge that:

  • You understand the nature of ESWT therapy

  • You have been informed of potential risks and benefits

  • You consent voluntarily to receive therapy services

  • You have had the opportunity to ask questions


5. LANGUAGE AND TERMINOLOGY

5.1 Symptom-Focused Communication

To maintain regulatory compliance and avoid practicing medicine, we use symptom-based language rather than disease names.

Examples of Appropriate Terminology:

5.2 "Therapy" vs. "Treatment"

We intentionally use the term "therapy" instead of "treatment" throughout all communications, documentation, and service descriptions to reflect the non-medical nature of our services.


6. SCHEDULING AND APPOINTMENTS

6.1 Appointment Booking

6.2 Cancellation Policy

  • 24-Hour Notice Required: Cancellations must be made at least 24 hours in advance

  • Late Cancellations: Cancellations with less than 24 hours notice may result in a cancellation fee

  • No-Shows: Missed appointments without notice may result in a full session fee

  • Rescheduling: We will work with you to reschedule when possible

6.3 Arrival Time

Please arrive 10-15 minutes before your scheduled appointment to complete any necessary paperwork and prepare for your session.


7. FEES AND PAYMENT

7.1 Payment Policies

  • Payment is due at the time of service unless alternative arrangements have been made

  • We accept cash, credit cards, and debit cards

  • Prices are subject to change with notice

  • All fees will be clearly communicated before services are rendered

7.2 Insurance

We do not bill insurance directly. However:

  • We can provide documentation for you to submit to your insurance provider

  • We cannot guarantee insurance reimbursement

  • You are responsible for full payment regardless of insurance coverage

  • Check with your insurance provider regarding eligibility for ESWT therapy coverage

7.3 Refund Policy

Services are generally non-refundable once rendered. However, we will consider refund requests on a case-by-case basis for:

  • Services not provided as described

  • Technical device failures preventing therapy delivery

  • Other exceptional circumstances


8. LIMITATIONS OF LIABILITY

8.1 No Medical Guarantees

AdvanceWave makes no guarantees, warranties, or promises regarding:

  • Specific health outcomes or results

  • Healing timelines or recovery rates

  • Effectiveness for any particular condition

  • Medical improvements or cures

Results vary by individual, and past results do not guarantee future outcomes.

8.2 Assumption of Risk

By receiving therapy services, you acknowledge and accept:

  • ESWT therapy involves inherent risks

  • Individual results may vary

  • Non-responders may experience no benefit

  • Rare side effects may include bruising or temporary discomfort

  • You assume all risks associated with therapy

8.3 Release of Liability

To the fullest extent permitted by law, you agree to release and hold harmless AdvanceWave LLC, its owners, employees, contractors, and agents from any and all claims, damages, losses, or liabilities arising from:

  • Your use of our therapy services

  • Any decisions made based on information provided by AdvanceWave

  • Any injury, illness, or adverse outcome related to therapy

  • Your failure to seek appropriate medical care

  • Any pre-existing or undiagnosed medical conditions

This release applies even if the claim arises from the negligence of AdvanceWave, except in cases of gross negligence or willful misconduct.


9. INTELLECTUAL PROPERTY

9.1 Website Content

All content on advancewave.ai, including text, graphics, logos, images, and software, is the property of AdvanceWave LLC and is protected by copyright and trademark laws.

9.2 Restrictions

You may not:

No photography, video recording, or audio recording is permitted in our facility without prior written consent from AdvanceWave management.


12. REGULATORY COMPLIANCE

12.1 Texas Law Compliance

AdvanceWave operates in compliance with all applicable Texas state laws and regulations, including:

  • Texas Occupations Code

  • Texas Administrative Code

  • FDA medical device regulations

  • Consumer protection laws

12.2 Scope of Practice

13. DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any legal action arising from these Terms or your use of our services must be brought in the state or federal courts located in Tarrant County, Texas.
